What does a will mean?
A will is a legal declaration made by a person during his lifetime to hand over property or certain benefits to the beneficiary after his death. It ensures the property and trust of the testator managed according to his wishes after his death.
What is meant by a legally binding will?
A legally binding will is a written document made during the testator's lifetime, contain the intention of the distribution of property after death, and meet the legal requirements so that can be enforced by the court. It involves the conditions of the testator, the beneficiary, and the property bequeathed
Does a will need to be stamped?
No. A legally binding Will does not require stamping at the Inland Revenue Authority of Singapore (IRAS) office.
Which act governs the will of Muslims in Singapore?
Muslim wills in Singapore are regulated under Sharia law.
Why do I need to make a will?
A will helps the testator express the intention of distributing assets after death other than faraid. Without The will, appointment of executor and probate process can be complicated, time-consuming, and involve high costs.
Why do I need a will if I don't have many assets?
Regardless of the asset's value, the property remains valuable to loved ones. The will helps leave protection, love, and can include future assets.
I am in my 30s/40s. Aren't you too young to write a will?
Nope. Life is unpredictable. After reaching the age of 18, a person is encouraged consider writing a will so that loved ones can inherit assets without delay.
Is the will mandatory?
A will is not absolutely obligatory in Islam. It is generally circumcised, but can be obligatory if a person has responsibilities such as debts, zakat, or hajj that have not been fulfilled. Will to non-heirs cannot exceed 1/3 of the inheritance without the consent of the heirs.
Do you need a lawyer to prepare a will?
Nope. In Malaysia, the law does not require a will to be prepared by a lawyer, as long as it is in writing and meet the requirements of relevant laws.
What happens if I die without a will?
Inheritance can be frozen because there is no executor, heirs are burdened with managing inheritance, assets and debts difficult to identify, and the estate administration process can take a long time.
Who can I appoint as Executor of my Will?
A Muslim aged 18 or over, sane, consents to the appointment, and is able managing the administration of the estate can be appointed as an executor.
What are the responsibilities of the Executor in my will?
The executor acts as a trustee, protecting the assets until they are distributed. The responsibility including finding the original will, applying for a Grant of Probate, collecting assets, paying debts/taxes, and distribute assets to beneficiaries.
How do you want to execute a will?
The execution of a will involves a sincere intention, writing a will, two witnesses, a maximum limit of 1/3 to non-heirs, clear beneficiaries, legal bequeathed property, consent of heirs if necessary, and execution after death by the executor of the estate.
Who can be a Guardian?
Anyone can be appointed as a guardian of a small child if they are 18 years old and above, sane mind, and able to handle property.
Who can be a beneficiary of my will?
Beneficiaries can include adopted children, friends, family members who are not faraid heirs such as grandchildren, charity, Islamic Religious Council, mosque, or surau, provided the property is not bequeathed more than 1/3.
What happens if the beneficiary dies during the execution process?
The beneficiary's share will depend on the circumstances: can be an inheritance to his heirs, returned to the original inheritance, distributed to other beneficiaries, given to the beneficiary next, or postponed if the beneficiary does not yet exist.
Who can be a witness to my will?
The witness must not be the beneficiary, not a member of the immediate family of the beneficiary, aged 18 years above, sane, third party to the testator, and consists of two men.
What is the responsibility of the witness?
Witnesses need to make sure the testator is sane, personally sign or give valid instructions for signed, signing each page, and providing complete information on the page the last The witness does not need to know the contents of the will.
Do I need to list overseas assets I own in my will?
Yes. Wills can list assets in Singapore and abroad. However, if you have external assets in othercountry, you also need to prepare a separate will in that country because each country have their own laws.
Can I cancel my own will according to Islamic law?
Yes. A will can be revoked through a new will, marriage or remarriage, destruction original will, or voluntary written revocation. Divorce alone does not invalidate a will automatically.
What is meant by "Last Will"?
A Last Will is a valid and final testamentary document that supersedes all previous wills. In the context of Islam, it has to comply with faraid principles.
Can someone challenge my will after I die?
Yes. Wills can be challenged on grounds of non-compliance with the law, invalid wills such as fraud or coercion, or heirs feel their rights are neglected.
What are the risks involved in writing a will?
Risks include the limit of 1/3 of the property for non-faraid heirs, the need for the heir's consent in the circumstances certain, and care for minor property recipients.
I don't have a Witness, can I appoint SmartWriter as my witness?
Yes. However, WasiatKu reserves the right to charge up to a maximum of SGD 100 per witness for every will.

This service is provided by SmartWills WasiatKu, an online platform owned and operated by WasiatKu Fintech Sdn Bhd.
Are SmartWills WasiatKu online wills valid?
Yes. Their online will is a legally binding document, drafted by a panel of lawyers and reviewed by internal legal counsel, including compliance with sharia law for Muslims in Malaysia.
Can I use this online service to write a will?
Yes. Any Muslim who is of sound mind and is either a Singapore Citizen aged 21 and above, or a Muslim foreigner with assets in Singapore, can use our online service to draft a valid Wasiat in Singapore, provided they understand the nature and purpose of creating a Wasiat.
What fees do I have to pay for this online service?
You only need to pay a one-time package fee for each Will you draft using our Service, as outlined on the Pricing page of our website. The listed package fees do NOT include any government taxes (including, but not limited to, GST) which will be charged separately (Fees and Charges).
What are my responsibilities under these terms & conditions of service?
You must read and comply with SmartWills instructions, pay fees/charges, ensure accurate information and complete, ensure that the will complies with the law and principles of Islamic inheritance, and obtain independent legal advice if unclear.
What will happen if I fail to fulfill my obligations?
The subscription may not be processed, or the will may be considered invalid under the law Singapore and Islamic law related to the division of property.
What are the risks of using SmartWills WasiatKu online services?
Online transaction risks apply. A will may also be deemed invalid if not complied with Terms and Conditions or not in accordance with Shariah law.
How to subscribe to the SmartWills Will writing service?
Register an account, prepare relevant documents such as beneficiary and executor information, log in to WasiatKu.com.my, click "Online Will Writing", read and agree to the Terms and Conditions, select "Will", then follow the instructions.
How does SmartWills WasiatKu provide for distribution of assets?
SmartWills WasiatKu allows the distribution of assets in the form of a percentage only. For a list of assets complete or custom distribution, customers should contact support.
Can I rewrite my will in the SmartWills WasiatKu service?
Yes. You can rewrite your will at any time through a new application online. Each rewrite is subject to the same package fee.
Can I cancel my subscription to this service?
Yes, before payment is made. If payment has been made, no refunds are allowed.
What should I do if there are changes to my contact details?
Notify WasiatKu immediately. You can update the information through the account in online or send an email to support@WasiatKu.com.my.
When will I receive my will in a printed copy?
After payment, customers are given 1 day for limited revisions or changes. After that, documents are printed and sent to the postal address within the next five working days.

Below are the Terms and Conditions for our Online Will product. Please read carefully and if necessary seek independent legal advice before using this service.
Online Will Writing Service Terms & Conditions SmartWills
The Online Islamic Will Writing Service (“Service”) is provided by MY SMARTWILLS PTE LTD (UEN No. 202231612H) (“SWPL”).
These terms govern the access, provision and use of the Service by individuals of the Muslim faith.
By pressing the "Accept" button, you agree that your Islamic Will will be prepared in accordance with the syariah and existing laws in Singapore and that you fully understand and accept these Terms & Conditions.
1. Definition
For the purposes of these Terms & Conditions, the following terms, unless the context otherwise requires, have the meaning as defined below. All other terms not defined herein shall be interpreted according to the meaning generally accepted in the industry based on the context of their use.
- "Will" - means the Islamic Will provided by SWPL for Muslim customers, which is subject to Sharia law and a limit of one third (1/3) of the total property after deducting debts.
- “Website” – Means https://www.WasiatKu.com.sg
- “Fees and Charges” – as stated on the website, excluding SST, subject to change with notice.
2. General Terms
2.1 You must have a valid username and password and subscribe to the Service.
2.2 The Service is for your exclusive use only. You are prohibited from using the Service on behalf of others EXCEPT our authorized distributors (hereinafter referred to as “SmartWriters”) who are authorized to use the Service on behalf of their customers.
2.3 This service is specifically designed for Muslim users who want to write a Will according to Faraid principles and Sharia law.
2.4 You acknowledge and agree to receive the Services through a secure Website in accordance with these Terms & Conditions.
2.5 SWPL reserves the right to reject the preparation of a Will that is found to be inconsistent with Faraid law or contrary to Islamic law.
2.6 SWPL reserves the right to refuse your subscription to the Service at its sole discretion without giving any reason.
2.7 SWPL will provide an electronic copy of the Will (in PDF format) by e-mail to the e-mail address you provided within 24 hours, or delivery of a printed copy (according to the additional premium service) to your postal address within five (5) working days, after you have provided complete and accurate information and after payment confirmation has been received by our payment gateway.
2.8 You may at any time cancel or stop subscribing to the Service provided the cancellation or termination is done before payment is made.
2.9 SWPL owns the copyright to the Will and you agree not to copy, reuse, share or distribute the contents of the Will to any other party or for commercial purposes.
2.10 You are encouraged to contact SWPL if you require additional information or clarification regarding the Service, or if you have special instructions for writing a Will.
2.11 SWPL reserves the right at its absolute discretion to amend, add, delete or change any of the Terms & Conditions from time to time by giving at least fourteen (14) days prior written notice. The notice will be displayed on the Website.
2.12 By pressing the "Accept" button, you fully understand that you have the right to consult a lawyer for advice on the Will before signing it. SWPL will not be liable for your failure to do so.
2.13 By pressing the payment button, you fully understand that you are responsible for the risk of accepting this Service.
3. Your Qualifications
3.1 To write a Will using our Services, you must:
- Be Muslim;
- Sane mind;
- Singapore citizens;
- 21 years and above
- Understanding Sharia law, the purpose and effect of making an Islamic Will.
4. Your Responsibilities
4.1 Upon receiving the original Will from SWPL, you must:
a) Check that the content complies with Shariah law and shows your true intentions.
b) Report any errors within three (3) working days.
c) If it is in order, sign the Will in the presence of two (2) witnesses who are both 21 years old and above.
d) Make sure the witnesses sign simultaneously.
e) Keep the original certified Will in a safe place.
4.2 Your failure to comply with clause 4.1 may render the Will invalid and/or unenforceable, and SWPL will not be liable for any loss or damage you suffer.
5. Fees and Charges
5.1 SWPL only accepts payment electronically (e-payment) through the payment gateway provided on the Website, either paid directly by you or through our authorized distributor (“SmartWriters”).
5.2 Subject to Clause 5.3, all payments made are final and non-refundable.
5.3 SWPL may, at its sole discretion, consider refunding the payment in the event of a technical error, transaction failure, or overpayment confirmed by the payment gateway provider.
5.4 SWPL reserves the right to review and change fee rates from time to time by giving reasonable notice through the Website. The new rates will come into effect on the date specified in the notice.
5.5 All fees stated are exclusive of any applicable government taxes, including but not limited to Sales and Service Tax (SST), digital tax, or any other levy imposed by the authorities. Those taxes will be charged separately according to the current rate.
6. Consent To Information Sharing
6.1 SWPL requires information as requested for the provision of Services (“Information”).
6.2 SWPL will keep the Information confidential and will only disclose it when necessary to auditors, lawyers, other professional advisors, regulatory authorities, and in accordance with the law.
6.3 You are entitled at any time to:
(a) withdraw your consent, if consent has been given, or give consent, if it has not been given;
(b) review the Information; and
(c) correct any inaccuracy by writing to the SWPL as specified in the PDS.
7. Personal Data Protection Act (PDPA)
7.1 In accordance with the Personal Data Protection Act 2010 (“PDPA”), SWPL is required to obtain your express and written consent before collecting, storing, and processing any personal data, including your sensitive personal data. This data is collected for the purpose of evaluating your application, providing and managing the products and services you subscribe to, as well as for compliance with applicable legal requirements.
7.2 Declaration: By pressing the “Accept” button, you declare that you have read, understand, and agree to be bound by SWPL's Privacy Notice and expressly authorize SWPL to:
a) Request, collect, store, and obtain all personal information specified in this form for the purpose of processing applications and implementing the Service; and
b) Collect and process your sensitive personal data, including but not limited to religious, health, or financial information, for the purposes of Will preparation and related service administration (if applicable).
7.3 By pressing the "Accept" button, you also confirm that all personal data provided is true, complete, accurate, and up-to-date. If there is any change to the information, you must notify SWPL immediately to ensure that our records are always updated and in line with PDPA requirements.
8. Service Limitations
8.1 SWPL does not give Sharia advice and is not responsible for determining the validity of your Islamic Will in the Sharia Court.
8.2 You are advised to seek the opinion of a Shariah advisor or licensed lawyer if there is any doubt.
9. Compliance with Faraid Law
You understand that an Islamic Will is only valid for a maximum of one-third (1/3) of the total property after paying debts and liabilities, unless all entitled heirs give written consent.
10. Confirmation After Death
10.1 After death, the execution of an Islamic Will requires confirmation by the Syariah Court to determine the validity and share of the heirs according to Faraid law.
10.2 Once confirmed, the executor must apply for a Probate Letter/Power of Administration in the Civil High Court to carry out the legal transfer of assets.
11. Limitation of Liability
11.1 SWPL:
a) Not responsible for the administration of your estate.
b) Not responsible for:
(i) Verifying your identity, age or capacity to make a Will.
(ii) Verify any information you provide.
(iii) Any delay or failure of performance due to circumstances beyond SWPL's control including natural disasters, fire, equipment failure, communication failure, strike, war, riot, terrorist, or governmental order.
(iv) Any fraud or misconduct of third parties including hacking or "phishing".
(v) Any loss or tampering with the Will while in your possession.
11.2 SWPL, its representatives or agents do not warrant that access to the Service will be continuous, uninterrupted or error-free. The Service is provided “as is” and “as available”. You use the Service at your own risk.
11.3 In addition to other disclaimers in the Terms & Conditions, SWPL disclaims all forms of express or implied warranties regarding the Services.
11.4 Neither SWPL nor its officers, directors, employees, shareholders, affiliates, agents, licensors, or third party suppliers shall be liable for any direct or indirect losses including special, consequential or punitive damages, arising from:
a) any defect, delay, interruption or failure of the Service;
b) any inaccuracy or data error in the Will;
c) damage, loss or error of data you provide for inclusion in the Will;
d) unauthorized use of or cyber attacks on the Website or Services;
e) your failure to comply with the law or the Terms & Conditions;
f) any event beyond SWPL's reasonable control;
g) SWPL's actions to exercise its rights under the Terms & Conditions; and/or
h) actions of parties other than SWPL.
11.5 Your sole remedy in the event of dissatisfaction is that SWPL will endeavor to re-produce a new Will. If still not satisfied, you should stop using the Service.
11.6 This clause applies to the extent permitted by law.
12. Indemnity
12.1 You agree to indemnify and hold SWPL, its officers, directors, employees, agents, and representatives completely free from any liability, loss, damage, fee, charge, legal cost, action, or claim of any kind arising out of or in connection with
a) Use, misuse, or unauthorized access to the Website and/or Services by you or any other party using your account;
b) Violation of any provision in these Terms & Conditions or applicable laws; or
c) Any infringement of intellectual property rights, including but not limited to copyrights, trademarks, or trade secrets belonging to SWPL or third parties, resulting from your use of the Services.
12.2 This indemnification obligation will continue in effect even after the termination of your access to the Website or Services.
13. Security and Computer Systems
13.1 All information and personal data you provide will be stored on secure servers owned by or operated on behalf of SWPL and protected through appropriate encryption techniques and electronic security controls. However, you acknowledge that no online system can be guaranteed to be completely secure, and that the security of your account also depends on your own measures to protect passwords, devices, and access to the Website.
13.2 You are solely responsible for all activity that occurs through your account, whether or not it is done with your permission. If you suspect any unauthorized access or breach of security, you must notify SWPL immediately.
13.3 SWPL shall not be liable for any loss, damage, or disclosure of data resulting from your negligence in protecting your account, password, or device. You shall indemnify SWPL against any liability or loss arising from unauthorized use or access to your account.
14. Intellectual Property Rights
14.1 Other than your personal information, all content, materials, text, graphics, logos, designs, software code, and data contained in the Service are the exclusive property of SWPL and are protected under Singapore copyright, trademark, and intellectual property laws.
14.2 Use of the Service does not grant any license, title, or implied permission to use any material, trademark, business name, or logo owned by SWPL or any third party without the prior written consent of SWPL.
14.3 Any copying, modification, reproduction, distribution, or reuse of material in any form without written permission is a violation of law and may result in civil and/or criminal action.
15. Termination
15.1 SWPL reserves the right, at its sole discretion, to terminate, suspend, or limit your access to the Website or Services at any time and without prior notice, should you violate any of these Terms & Conditions, the provisions of applicable law, or the rights of SWPL, other users, or third parties.
15.2 Termination does not affect SWPL's rights or remedies that existed prior to the date of termination. All of your outstanding obligations to SWPL on or before the date of termination shall continue in effect until paid in full.
15.3 SWPL shall not be liable for any loss or damage—whether direct, indirect, special, or consequential—suffered by you as a result of the termination or suspension of access under this clause.
16. Law and Jurisdiction
16.1 These Terms & Conditions are governed by Singapore law and Shariah law in force in Singapore.
16.2 If any provision is deemed invalid, it will be replaced by a valid provision that is closest to the original intent, while the remainder of the Terms & Conditions remain in effect.
16.3 Any dispute regarding the validity or administration of an Islamic Will should be referred to the Syariah Court, while the administration of immovable property assets or bank accounts should be confirmed through a Grant of Probate from the Civil High Court.
17. Inquiries and Complaints
17.1 If you have any queries, complaints or disputes relating to the Service, you should refer the matter to SWPL through the details specified in the PDS.
17.2 SWPL will make every effort to answer questions and resolve issues raised.
17.3 You will need to provide full details of your inquiry or complaint and it will be dealt with in accordance with SWPL's internal procedures.

For other services offered by WasiatKu Fintech Sdn Bhd, refunds may be considered based on specific situations and subject to management approval. Please note that an administration and processing charge of Singapore Dollars One Hundred (SGD 100.00) will be charged for each approved refund.
GOVERNING LAW
This agreement will be interpreted and governed in accordance with the laws of Singapore. You agree to submit to the exclusive jurisdiction of the Courts in Singapore, to resolve any disputes arising out of or in connection with this agreement.
MISCELLANEOUS
Failure to exercise or enforce any right or provision in these terms and conditions shall not be deemed a waiver or release of such right. If any provision in this Agreement is found to be invalid, illegal or unenforceable in whole or in part under any applicable law, such provision shall be modified to the extent necessary to make it valid and enforceable, without affecting the validity and enforceability of other provisions in this Agreement. Any rights not expressly granted herein are fully reserved.

The Online Will Writing Service (“Service”) is provided by MY SMARTWILLS PTE LTD (UEN No. 202231612H) (“SWPL”), a company incorporated in Singapore and subject to the laws of Singapore.
2. What is this Service?
You can write a Will online by accessing our Website at www.WasiatKu.com.my and following the step-by-step instructions provided.
Upon completion and successful payment through an approved payment gateway, a legally valid printed copy of the Will will be generated and sent by registered courier service to you to be signed in accordance with the Wills Act 1959.
3. What is a Will?
A will for Muslims is a statement of desire or a voluntary gift by a Muslim made during his lifetime, effective after his death, to give part of his property to an individual or a purpose permitted by Sharia law.
According to the Muslim Wills Act (Federal Territories) 1993 and the State Muslim Wills Enactment, Wills for Muslims:
Can only be made by someone who is Muslim, sane, and of sufficient age;
Must comply with the Faraid principle to ensure the rights of heirs are preserved; and
Can only involve up to one third (1/3) of the total amount of the inheritance after deducting debts and liabilities, unless all the entitled heirs agree.
Muslim wills are not subject to the Wills Act 1959, as the act only applies to non-Muslim individuals. However, every execution of an Islamic Will still requires confirmation by the Syariah Court to determine the validity of the Will and the share of the heirs according to Faraid law.
After the confirmation, the Executor needs to obtain a Probate Grant from the Civil High Court to enable the execution and transfer of assets to be done legally to the heirs or beneficiaries.
4. Who can write a Will?
Any Muslim individual who meets the following conditions can make a Will in accordance with Shariah law and the laws in force in Singapore:
Sane mind;
Singapore citizens;
Be at least 21 years and above;and
Having the ability to understand the nature, law, and effect of making a Will according to Sharia law.
Wills for Muslims must comply with the Faraid principle, where the distribution of property to heirs cannot exceed one-third (1/3) of the total property after deducting debts and liabilities, except with the consent of all entitled heirs.
5. What fees and charges are payable for this Service?
A one-time fee is charged based on your chosen package as stated on our official website.
All fees are exclusive of Sales and Service Tax (SST), and SWPL reserves the right to revise fee rates at any time with due notification (“Fees and Charges”)
6. What are my responsibilities?
6.1 Read, understand, and follow all the instructions provided on our website and ensure that all steps are completed correctly before the final confirmation of the Will.
6.2 Provide accurate, clear, and complete information, including information related to heirs, beneficiaries, and appointed Executors.
6.3 Ensuring that the Will is prepared in accordance with the requirements of Syariah law and in accordance with the provisions of the Muslim Wills (Federal Territories) Act 1993 or the relevant State Islamic Wills Enactment, including a maximum limit of one third (1/3) of the total property that can be bequeathed without the consent of all heirs.
6.4 If you are unsure about the terms, validity, or appropriateness of the Will according to Sharia law, you are advised to seek the opinion of a Sharia advisor or licensed lawyer experienced in Islamic inheritance law.
7. What happens if I fail to fulfill my responsibilities?
If the information provided is inaccurate or incomplete, your Will may not be legally valid, and SWPL will not be responsible for any legal implications that may arise.
8. What are the main risks?
Online security risks (including data intrusion or system disruption) still apply.
In addition, failure to comply with the Terms & Conditions may cause the Will to be considered invalid or void.
9. What are the inherent risks in writing a Will?
9.1 A Will does not supersede an earlier nomination, such as insurance or Central Provident Fund (CPF) nominations, if any.
9.2 If your named beneficiary in the Will is below the age of 21 years old at the time of your death, his/her share will be held in trust by the appointed guardian for administration until he/she reaches 21 years of age.
10. How can I subscribe to this Service?
Subscription steps:
10.1 Create an account and log in to our official website.
10.2 Provide all important information (NRIC/Passport of heirs, beneficiaries, and executors).
10.3 Click on “Start Online Will Writing”.
10.4 Read and confirm the Product Disclosure Sheet, Terms & Conditions, and Disclosure Consent.
10.5 Follow the on-screen instructions to complete payment and verification.
11. Who can be my Executor?
Anyone who is at least 21 years old, of sound mind, consents to the appointment, and is capable of administering your estate can be an executor.
12. How many Executors do I need?
At least one (1) executor is required, but two (2) executors are recommended if there are minor beneficiaries to ensure a more secure execution.
13. Who can be my witness?
Anyone who is at least 21 years old and is not named as a beneficiary or heir in your Will can be a witness.
14. How does a Will distribute assets?
This service allows the distribution of assets in percentage (%). Certain values are not specified in absolute terms to facilitate flexibility.
15. What does "Last Will & Testament" mean?
A duly signed and witnessed Will will automatically revoke all previous Wills, and is considered your last Will unless superseded by a new Will.
16. Can I rewrite the Will? How much does it cost?
Once finalised, a Will cannot be modified. Any amendment can only be done by preparing a new Will through our system.
17. Can I cancel the subscription?
Subscriptions can be canceled before payment is made. Once the payment has been successfully processed, no refunds will be given as per the Refund Policy.
18. What should I do if my contact information changes?
You should inform SWPL of any changes to your contact details. To update your information, you may visit our Website for assistance.
19. When will I receive an electronic or printed copy of my Will?
SWPL will provide the electronic copy of the Will (in PDF format) as an email attachment to the email address you provided within 24 hours, or deliver a printed copy as part of our add-on premium service to your postal address within five (5) working days after you have provided complete and accurate information and we have received payment confirmation through our payment gateway.
